Tovella Terms of Use

Version of 26 October 2026. Effective from the date of publication at tovella.ru/terms; there are no earlier versions. The Russian text (tovella.ru/terms) is the only legally binding version; this English translation is provided for convenience, and in case of any discrepancy the Russian text prevails.

The Service is operated by Timofey Sergeevich Gromov, a citizen of the Russian Federation (hereinafter "we", the "Operator"). As of this version the Operator is not registered as a sole proprietor: the Service is free. Contact e-mail — hello@tovella.ru; details are in section 17.

In short (does not replace the full text)

Tovella helps a group of people decide where to go: you send links to places, we turn them into cards, group members vote, and matches become plans. The Service is for people aged 18 and over. All features are free today; paid features, if introduced, will be activated only by your separate action, with the right to cancel at any time. Cards are built automatically from open sources using artificial-intelligence models — check opening hours and the address before you go. Everything you post in a group is visible to its members, including those who joined via an invite link. How we handle your data is described in the Privacy Policy; we send promotional messages only with your separate consent. Questions and claims: hello@tovella.ru.

1. Terms

1.1. Service, Tovella — the Operator's computer program and database, available through the Telegram mini app opened by the Tovella bot, the web app https://app.tovella.ru, the website tovella.ru, and mobile apps once released. All access methods are one Service under one Agreement.

1.2. User, you — an individual who uses the Service.

1.3. Account — the User's account in the Service (section 4).

1.4. Group — a set of Users created by a User, with a shared deck of cards, voting, chat and plans.

1.5. Card — a record about a place or event: name, description, address and coordinates, opening hours, up to five images, link to the source.

1.6. Link — the address of a page or post in an external service that a User sends to create a Card.

1.7. External services — third-party services Tovella relies on: Telegram; map and place-information services; social networks and video platforms that Links point to; data-collection services; providers of artificial-intelligence models; hosting and storage; payment services. They are listed by name, role and country in the Privacy Policy.

1.8. User Content — everything a User places in the Service: Links, group names and images, messages, uploaded photos, the User's own Cards, votes, plans.

1.9. Privacy Policy, Policy — the document describing what data we process, why and on what basis: tovella.ru/privacy.

1.10. Messaging Consent — a separate document by which a User may allow us to send informational and promotional messages: tovella.ru/consent.

1.11. Paid features — features provided for a fee (section 10). None exist as of this version.

2. Status of the Agreement and acceptance

2.1. This Agreement is a contract of adhesion (Article 428 of the Civil Code of the Russian Federation): its terms are accepted in full, without reservations. If Paid features are introduced, with regard to them the Agreement together with the terms of a specific feature will constitute a public offer (Article 437(2) of the Civil Code).

2.2. With regard to the use of the Service's software, the Agreement is a licence agreement concluded in the simplified manner (Article 1286(5) of the Civil Code).

2.3. You accept the Agreement by any of the following: pressing the acceptance button on the sign-in screen; registering or signing in to an Account; sending a Link to the bot or otherwise starting to use the Service.

2.4. By accepting the Agreement you confirm that you are at least 18 years old, have legal capacity, and use the Service for personal, family and household needs unrelated to business. If this is not the case, do not use the Service.

2.5. The Agreement is in force from acceptance until termination under section 13.

2.6. The binding text is in Russian. Where a translation differs, the Russian text applies.

2.7. The Agreement, the Policy, the Messaging Consent and the terms of Paid features (when introduced) together constitute the entire agreement between you and the Operator.

3. What Tovella is and is not

3.1. The Service lets you: create Groups and invite people; send Links and receive Cards built from them; create your own Cards; vote for Cards and learn about matches; set plans and reminders; chat with Group members; receive notifications in Telegram and in the app.

3.2. The Service does not book tables or tickets, does not sell venue services, is not an agent of venues, event organisers or Users, does not verify venues and does not guarantee their availability, opening hours, prices or quality. Where to go, and everything that follows from that, is your decision.

3.3. Cards are built automatically: the program obtains information from open sources and External services, selects images and composes a description using artificial-intelligence models. Such information may be incomplete, outdated or wrong. Check the address, opening hours and conditions with the venue or organiser before visiting.

3.4. We develop the Service: features may be added, changed or disabled. We will give at least 30 days' notice before discontinuing the Service as a whole.

3.5. Telegram is a third-party platform with its own terms that you accept separately. Access via Telegram depends on Telegram's operation and on restrictions that telecom operators or state authorities may impose; in such cases the Service remains available through the web app https://app.tovella.ru, unless the restrictions affect it as well.

4. Account

4.1. There are two ways to sign in:

  • via Telegram — Telegram passes us your identifier, name, username, profile photo and interface language; your phone number only if you yourself allow it to be shared;
  • by e-mail and password — at registration you provide an e-mail address, password, name, login and phone number (registration this way is impossible without it).

4.2. One person — one Account. The Account is personal: it may not be transferred, sold or lent to others.

4.3. Account data must be accurate and up to date. The phone number and e-mail address must be your own and in use. We may ask you to confirm the number or address (for example, with a code) and restrict the features that rely on them until confirmed.

4.4. Search by phone number. Users who have your phone number can find your Account in the Service by that number (and see your name and photo) in order to invite you to a Group. The current version has no setting to switch this off: if you do not want to be found by number, write to hello@tovella.ru and we will remove your number from search.

4.5. You are responsible for access to your Telegram account, e-mail and password and for all actions performed in your Account. Tell us if you learn of unauthorised access.

4.6. The Service is intended for persons aged 18 and over. If we learn that an Account belongs to a person under 18, we block the Account and delete its data.

4.7. Use of the Service for business purposes (on behalf of a venue, agency or event organiser) is not provided for in the current version — write to us at hello@tovella.ru.

5. Licence to use the Service

5.1. The Operator grants you a simple (non-exclusive), revocable, non-transferable licence without the right to sublicense, to use the Service for its intended purpose through the interfaces provided, worldwide, for the term of the Agreement. For free features the licence is free of charge.

5.2. It is prohibited to:

  • circumvent the Service's technical restrictions and protection;
  • access the Service in an automated way (bots, scripts, scraping) or extract data from it in bulk or systematically, except as expressly permitted by law or by the Operator in writing;
  • decompile, disassemble or modify the Service's software, except as expressly permitted by Article 1280 of the Civil Code;
  • resell, rent out or embed the Service or its parts in other products;
  • create load that disrupts the Service or interfere with its operation;
  • use the Service for mailings, advertising, spam or data harvesting;
  • impersonate another person or the Operator.

5.3. The Operator may set and change technical limits: the number of Links per period, the processing queue, size and formats of uploaded files, the number of Groups and members, and others.

5.4. We may use suggestions and feedback you send us to develop the Service without any obligation to you.

6. User Content and Links

6.1. You keep the rights to your User Content. By posting Content you warrant that you are entitled to do so — the Content was created by you or you hold the necessary permissions, including the consent of people shown in photographs (Article 152.1 of the Civil Code) — and that it does not violate the law or third-party rights.

6.2. You grant the Operator a simple (non-exclusive), royalty-free licence to User Content for the period it is in the Service, for the purposes of operating the Service: to store, reproduce, process (including automatically and with the involvement of External services and artificial-intelligence models), display to members of your Groups, and make backups. We do not publish User Content to the general public and do not use it in advertising without your separate consent. After deletion, Content remains only in backups (no longer than 30 days) and where the law requires retention.

6.3. Links. By sending a Link you instruct us to build a Card from it: to obtain information about the place or event from map services, from the open page of a social network or video platform (directly or through a data-collection service), to process the resulting text, audio and video with artificial-intelligence models, to select images and compose a description. Some of these External services are located outside Russia; such transfer is necessary to carry out your instruction. We do not store or show the whole video — a Card contains no more than five frames and a link to the original. Send only Links to open posts available without signing in to the respective service.

6.4. We may decline to create a Card without giving details: when the Link contains no place or event, when the material shows people in close-up or prohibited or unwanted imagery, when the Link leads to a private post, when the limits of clause 5.3 are exhausted, or when an External service is unavailable.

6.5. Third-party materials in Cards — photos, frames, names, descriptions, addresses — belong to their right holders and are presented for information purposes with attribution to the source. No rights to them pass to you; they may not be extracted from the Service for other uses.

6.6. It is prohibited to post in the Service, to send Links to, or to use the Service to distribute: material that violates the law; extremist material and symbols of banned organisations; pornography; promotion of violence, drugs, weapons or suicide; insults, harassment, threats, discrimination; other people's personal data and images without their consent; material infringing copyright or related rights; malicious code; spam and advertising without the Operator's consent; misleading information; material involving minors.

6.7. We may, but are not obliged to, review User Content automatically and manually and, in case of a violation of the Agreement or the law, delete or hide it, reject Links and restrict the Account without prior notice.

6.8. Requests from right holders and persons depicted. With regard to User Content the Operator is an information intermediary (Article 1253.1 of the Civil Code). If you believe that material in the Service infringes your rights, write to hello@tovella.ru: identify the material (a link to the Card or a description sufficient to find it, the Group name), the right infringed and the basis on which it belongs to you, and your contact details. Right holders' claims are handled under Article 15.7 of the Federal Law "On Information, Information Technologies and Protection of Information" — within 24 hours of receipt we remove the material or request the missing information. At the request of the author of a video from which frames were taken, the Card is deleted entirely.

6.9. The User who posted Content is responsible for it. If third parties bring claims against the Operator because of your Content, you reimburse the Operator's expenses on such claims within the limits set by law.

7. Groups and invitations

7.1. A Group is created by a User, who manages its name and image and its invite links, and may delete the Group.

7.2. Group members see each other's name, Telegram username (if any) and profile photo, as well as the shared deck of Cards, voting results to the extent provided by the Service's features, chat messages and the Group's plans.

7.3. Invite links have no expiry and no usage limit: anyone who has the link can join the Group and see its contents. Share the link only with people you want in the Group. The Group creator may revoke the link at any time; this does not affect those who have already joined.

7.4. By inviting someone by phone number or searching for them by number, you confirm that they do not object to such an invitation. Numbers that do not match an Account are not stored.

7.5. If the current version of the Service has no button to leave a Group or remove a member, write to hello@tovella.ru and we will do it manually.

7.6. Deleting a Group deletes its deck, votes, chat and plans for all members.

8. Group chat

8.1. In the chat, Group members exchange text messages; system messages from the Service about matches and plans also appear there.

8.2. Messages are stored on the Operator's servers in Russia until the Group is deleted (and in backups for no more than 30 days after that). The chat is not end-to-end encrypted: messages are accessible to Group members and, in cases provided by law, to the Operator and authorised state bodies.

8.3. Clause 6.6 applies to messages. Do not send passwords, payment details or other information you would not want disclosed.

9. Voting, plans, notifications, availability

9.1. A match occurs when enough Group members, under the Service's rules, have voted for a Card. A match or a plan is not an obligation of Users to each other, nor an obligation of the Operator.

9.2. Plans and reminders are an auxiliary feature; we do not guarantee their delivery at an exact time.

9.3. Service notifications — about matches, new Cards, plans, reminders, being added to a Group — are part of the Service. They arrive via the Telegram bot and in the app feed. Most can be switched off in settings; the notification about being added to a Group cannot, otherwise you would not know you are in it.

9.4. Informational and promotional messages (Service news, selections, offers) are sent only with your separate consent (Messaging Consent). You may withdraw it at any time; refusal does not affect access to the Service.

9.5. Links are processed in a queue; usually this takes minutes, longer under load. The Service may be temporarily unavailable due to maintenance, updates, failures of External services, Telegram restrictions and other causes beyond our control. We try to announce planned work in advance.

10. Paid features

10.1. As of this version all features of the Service are free: the Operator accepts no payments and provides no paid services.

10.2. If Paid features are introduced, their scope, price, term, payment frequency and the terms of renewal, cancellation and refunds will be published on the website and in the app in advance and will become part of a new version of the Agreement under section 14. A Paid feature will be activated only by your separate explicit action; we will give at least 30 days' notice before making an existing free feature paid. Consumer protection legislation will apply to Paid features, including the rules on cancelling a service at any time and on recurring payments.

11. Intellectual property

11.1. The name and mark Tovella, the Service's software, design, texts, databases and other elements belong to the Operator or are used by it on a lawful basis. You receive only the licence in section 5; the Agreement transfers no other rights.

11.2. The Service's databases (including Cards) are protected as an object of related rights (Article 1334 of the Civil Code); extracting a substantial part of them is prohibited.

11.3. Names and marks of third parties — Telegram, Google, Yandex, TikTok and others — belong to their owners. The Operator is not affiliated with them and does not represent them.

12. Liability and its limits

12.1. The Operator is liable for the operation of the Service within the limits set by law. Nothing in this section limits the rights granted to you by law.

12.2. The Operator is not liable for: venues and events — their availability, quality, prices, opening hours, correspondence to the Card; the actions of other Users and their Content; the operation of Telegram, External services and telecom operators, and access restrictions imposed by third parties or state authorities; your devices, software and connectivity; decisions you make on the basis of Cards and their consequences.

12.3. Free features are provided in the condition they are in at the time of use; the Operator does not guarantee their uninterrupted operation but makes reasonable efforts to keep the Service stable.

12.4. The User is liable for violations of the Agreement and the law in accordance with the law.

13. Suspension, blocking, termination

13.1. You may stop using the Service at any time. In the current version an Account is deleted on request by e-mail to hello@tovella.ru sent from the e-mail address or Telegram account linked to the Account. The Account and its data are deleted within 30 days of receiving the request. After deletion the following remain: anonymised information; data we must keep by law (for example, payment documents); backups — no longer than 30 days; records needed by other members of your Groups (for example, chat messages) — without reference to you.

13.2. The Operator may restrict features, suspend or block an Account in case of a violation of the Agreement or the law, a threat to the security of the Service or other Users, or at the request of an authorised body. Where possible and not prohibited by law, we notify you of the block and its reason via the bot, the app or e-mail, and for a remediable violation we give time to remedy it. Refunds for the unused period of a Paid feature upon blocking follow the terms of section 10.

13.3. If the Service is discontinued as a whole (clause 3.4), Accounts and data are deleted as in clause 13.1.

14. Changes to the Agreement

14.1. A new version is published at tovella.ru/terms and in the app with its date. We notify you of material changes via the bot, the app or e-mail at least 10 days before the version takes effect; changes required by law take effect on the date set by law.

14.2. Using the Service after a version takes effect means accepting it. If you disagree with the new version, stop using the Service and delete your Account (clause 13.1). A new version applies to an already paid period of a Paid feature only if it does not worsen your position.

15. Governing law and disputes

15.1. The Agreement is governed by the law of the Russian Federation.

15.2. Send claims to hello@tovella.ru or by post to the Operator's address (section 17), stating your Account (Telegram name or e-mail address), the substance of the claim and a contact for the reply. We reply within 10 days of receipt.

15.3. Sending a claim is recommended but is not a mandatory precondition for going to court and does not limit your rights.

15.4. Disputes are resolved by a court in accordance with the law. You may also apply to Roskomnadzor (personal data) and, where the Consumer Protection Law applies to the relationship, to Rospotrebnadzor and to a court of your choice (Article 17 of that Law).

16. Miscellaneous

16.1. We contact you via the Telegram bot, the app and the Account's e-mail address; a message is deemed received on the day after it is sent. You contact us via hello@tovella.ru.

16.2. The invalidity of a single term does not invalidate the rest.

16.3. The Operator may assign its rights and obligations under the Agreement to another person upon transfer of the Service (including to a company set up by the Operator), giving you at least 30 days' notice; in that case you may withdraw from the Agreement.
